The MyClubConnect Business web platform is owned and operated by Club Connect UK as MyClubConnect (“we”, “our” and “us”). Club Connect UK Limited is a private limited company, registered in England (company number: 09117335, registered office: 68 Church Road, Enfield, Middlesex, EN3 4NU).
By registering to use MyClubConnect Business, nightclubs, brands (club nights) and promoters (“you”, “your” and “them”) you are subject to and agree to be bound by the Terms. You should make yourself aware of the Terms and print a copy for future reference if necessary. The terms are available for your reference at any time on MyClubConnect Business. These Terms were updated last on 26th May 2018.
These Terms and Conditions, your use of MyClubConnect Business and any related dispute or claim (contractual or non-contractual) shall be governed by, and interpreted in accordance with, English law and subject to the non-exclusive jurisdiction of the English courts. We reserve the right to bring any action(s) in any other court(s) of competent jurisdiction.
We may amend these Terms at any time. We will send you an email to notify you of the amended Terms and will also ask you to accept the amended Terms by selecting the “I agree” tick box upon your next login to MyClubConnect Business. Please make sure you read the Terms and understand them before clicking “I agree”. Should you not accept these amendments, you may choose to stop using MyClubConnect Business at any time and delete your account in your settings.
In using MyClubConnect Business, you agree that:
In making MyClubConnect Business available to you, we are granting you a limited licence to use MyClubConnect Business in accordance with the Terms.
You will comply with all applicable laws.
All information provided by you to us, including on registration with MyClubConnect Business, is true, accurate, up-to-date and not misleading in any respect. You can update your information and details at any time by accessing your settings via MCC Business.
You will not use MyClubConnect Business for any unlawful purpose.
You will refrain from doing anything which we believe (in our reasonable opinion) to be disreputable, or capable of damaging our reputation.
You will not use MyClubConnect Business in any way that causes MyClubConnect Business to become damaged or impaired, or in any way compromises the effectiveness, efficiency or functionality of MyClubConnect Business.
You will not upload or transmit any computer viruses, macro viruses, trojans, worms or other harmful programmes designed to interfere with, interrupt or disrupt the normal operating procedures of a computer, smart phone, computer tablet or other mobile technology.
You will not attempt any unauthorised access to any part of MyClubConnect Business, access or attempt to access the accounts of other users, penetrate or attempt to penetrate any security measures, or attempt to use MyClubConnect Business in any manner which violates or infringes the rights of any person, firm or company (including, but not limited to, rights of intellectual property, rights of confidentiality or rights of privacy).
You will not disseminate any content which is not related to clubbing, defamatory, obscene, or may have the effect of being harassing, threatening or abusive to an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, disability or otherwise.
We will do our best to offer you a smooth service, but we give no guarantees that MyClubConnect Business will be fault free or that the services provided will be uninterrupted. If a fault does occur, please contact us and we will attempt to correct the fault as soon as we reasonably can.
We will occasionally restrict your access to MyClubConnect Business to carry out repairs, maintenance or to introduce new functionality or services and we will endeavour to keep disruption to a minimum.
New services are subject to a period of testing. This means that a new service may not perform with complete functionality, may be undergoing testing, may be inconsistently available, may have software “bugs” being fixed by us and may have other issues affecting availability and functionality.
You acknowledge and agree that all intellectual property rights (including, but not limited to, copyright, trademarks, logos, text, graphics, photos, sound, illustrations, animations and videos or rights in and to our software, applications and website) in all material or content contained within MyClubConnect Business shall remain at all times owned by us or our licensors. Except as expressly set out in these Terms, nothing in these Terms gives you any rights in respect of any intellectual property owned by us or our licensors and you acknowledge that you do not acquire any ownership rights by using MyClubConnect Business.
You may not engage in the harvesting of content displayed within MyClubConnect Business, including, but not limited to screen scraping, spidering, database scraping, or any other automatic means of obtaining content on MyClubConnect Business. You may not use MyClubConnect Business in any manner with the intent to damage, interrupt, disable, overburden, or impair the services.
You agree that by submitting any content, information, images or otherwise for publication on MyClubConnect Business you retain any copyright you may have in the content, however you grant us and our affiliates a perpetual, irrevocable, worldwide, non-exclusive, royalty-free and fully sub-licensable right and licence to use, reproduce, edit, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such content (in whole or in part) and/or to incorporate it into other works in any form, media or technology, whether for commercial or non-commercial purposes. You waive any moral rights you may have in, or to be identified as the author, of the content.
You are solely responsible for your content (including content you share with other sites, such as social networking sites) and we do not endorse content or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any and all liability in connection with your content.
MyClubConnect Business is a promotional tool that we provide to help nightclubs, brand (club night) owners and promoters to connect with and sell to clubbers more efficiently. Subscribing to use MyClubConnect Business does not guarantee use of the platform. Every user’s affiliation with a venue or brand must be verified first by MyClubConnect.
On MyClubConnect Business you will have access to a number of tools when you pay your monthly subscription:
You will be able to take control of and edit your venue or brand profile
Create and display club events
Send push notifications
Sell tickets to events
Allow Nightclub Entry Rewards
Manage other user access to your venue or brand
Paying your monthly subscription to use the tools on our platform does not guarantee any impressions or views on your events, entries to your events nor ticket sales.
Some of these tools have limitations that may prevent you from using them in their entirety. Where there are limitations, these are explained on MyClubConnect Business next to each functionality. Such a limitation would be that push notifications are disabled until you enable Nightclub Entry Rewards for a number of clubbers per event. All these limitations are in place only to ensure all stakeholders put in to the clubbing ecosystem in order to get something out of it.
Paying for Featured Events on MyClubConnect Business also does not guarantee entries nor ticket sales for your events. You will be given an estimated and a maximum number of views based on your target criteria and the amount of money you put towards the Featured Event. You will receive no more views than the maximum possible views. MCC Credits will only be taken from your account for the views you received; where views do not reach the estimates by the end of the Featured Event period, the remaining MCC Credits will remain in your account.
Paying for an extra promotional feature only guarantees the service to which the extra promotional feature specifically refers. It does not guarantee any impressions or views on your events, entries to your events nor ticket sales, i.e. if you pay for a sponsored Instagram post on our Instagram account, you will receive just that and no guarantee that it will lead to event success.
Delivery of paid features will be provided on the date, time and for the duration you choose within the platform.
All extra promotional features are non-refundable.
If your monthly subscription fee is not paid for whatever reason, access to MyClubConnect Business may be locked pending subsequent payment.
You can unsubscribe from MyClubConnect Business at any time by clicking Unsubscribe through the platform. You must click unsubscribe at least 7 days before the next billing date to guarantee you do not get charged for your next monthly billing cycle.
Payment for services on MyClubConnect Business is all handled through Stripe.
We store none of your financial information or card details on our own systems.
Payment scheduling for revenue earned through ticket sales is according to Stripe’s guidelines.
We abide by Stripe’s terms and conditions which can be found here: https://stripe.com/gb/connect-account/legal.
We also keep a history of featured events. These may be used solely to improve the Featured Events service in the future and can be accessed by you or us to see past purchase activity.
Although we do our best to ensure that the information inputted into MyClubConnect Business is accurate by implementing prompts and explanations of what certain data fields mean, MyClubConnect accepts no responsibility for wrong or inaccurate information on the platform.
It is your responsibility to control and ensure the accuracy of the information about your venues, brands and events including by deciding who becomes an admin or contributor of your venue or brand and has relevant permissions to edit it.
We reserve the right to remove any content on MyClubConnect Business without refund, warning or explanation.
We accept no responsibility for the decline of a request for verification to use MyClubConnect Business. This will be because, 1) the proof of your affiliation with the venue or brand was not strong enough, or 2) your personal contact details were incorrect and we could not contact you to verify your affiliation. If you have been refused verification but believe this was an incorrect decision and you have proof to that effect, please contact us at [email protected]
Consistently incorrect information and event details could detract from the reputation of MyClubConnect as an information source. Therefore inputting consistently incorrect information (such as event start time, address, name, music policy etc.), not updating upcoming attendees of important updates that may affect their decision to attend and and abusing the system for means other than the advancement of your clubbing organisation may result in your expulsion from MyClubConnect Business. We reserve the right to decide what “consistently” means. You will receive no refund for that month or previous months when a ban occurs. We reserve the right to increase or decrease the monthly subscription of MyClubConnect Business. We also reserve the right to increase the price of any further payable features including ticket booking fees. Notification of any changes to the pricing of MyClubConnect Business will be communicated by email at least 1 month in advance of the new pricing being implemented.
MyClubConnect is a marketplace for nightclub events but it is your responsibility to allow entry to app customers who have redeemed Nightclub Entry Rewards to your event or who have bought tickets to your event. We cannot be held responsible for you denying entry to clubbers who should be permitted entry. We run a 2 strike policy against venues and brands who wrongly or incorrectly refuse entry to anyone who has bought tickets or redeemed Nightclub Entry Rewards on the MyClubConnect mobile app. On the second strike, we reserve the right to permanently ban you and the venue or brand from MyClubConnect Business.
We shall not be liable under any circumstances with respect to any services provided under MyClubConnect Business, or any other subject matter of these Terms, for: (i) any indirect losses, meaning a loss to you which is a side effect of the main loss or damage and where you and we could not have reasonably foreseen that type of loss arising at the time of entering into these Terms; (ii) losses not caused by our breach; (iii) your actions or inactions; and (iv) any matters beyond our reasonable control (including network failure).
We shall not be liable for any content of information you provide to us, or the content of any other user of MyClubConnect Business.
You agree that by submitting any content to MyClubConnect, you retain any copyright you may have in the content, however you grant us and our affiliates a perpetual, irrevocable, worldwide, non-exclusive, royalty-free and fully sub-licensable right and licence to use, reproduce, edit, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such content (in whole or in part) and/or to incorporate it into other works in any form, media or technology, whether for commercial or non-commercial purposes.
We are not affiliated with, and have no agency or employment relationship with, any third party service provider used to provide services under MyClubConnect Business and we have no responsibility for and disclaim all liability arising from, the acts or omissions of any such third party service provider.
Nothing in these Terms shall exclude any liability we may have at law. You have certain rights under the law. These include that we will provide MyClubConnect Business to a reasonable standard and within a reasonable time. Nothing in these Terms is intended to affect these statutory rights. For more information about your statutory rights you can contact your local Citizens Advice Bureau or Trading Standards Office.
We may terminate these Terms and close any account you have with us by writing by email to your registered email address. We may also terminate these Terms and close your account without notice if you breach any of your obligations under these Terms, if court or bankruptcy proceedings are brought against you or if your use of MyClubConnect Business is deemed unacceptable by us.
We reserve the right to suspend, restrict or terminate your access to MyClubConnect Business at any time without notice if we have reasonable grounds to believe you have breached any of these Terms. This shall not limit our right to take any other action against you that we consider appropriate to defend our rights or those of any other person.
Termination shall not prejudice any other right or remedy you or we may have in respect of accrued rights (including rights in respect of any breach) or liabilities which arose prior to termination.
You are under no obligation to use MyClubConnect Business and may simply choose to stop using it at any time by clicking Unsubscribe through the platform.
These Terms are not intended to give rights to anyone except you and us, unless otherwise expressly indicated by us within these Terms. We may assign our rights and obligation under these Terms without your prior consent to any new provider of MyClubConnect Business.
If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then the provision will be deleted. Any such deletion will not affect the validity and enforceability of any of the other provisions of these Terms.
